FEES

APPLICABLE AS OF JULY 1st, 2019 | IN EURO CURRENCY | VAT EXEMPT

The Complainant must pay MFSD a fixed fee, as proportioned below, at the time the complaint is filed. In any case, the Complainant bears fees and out-of-pocket expenses.

The amount paid by the Complainant to MFSD are cashed in any case, even in the event of termination or suspension of the procedure and are normally non-refundable, unless the Panelist deems, in exceptional cases, to order their partial refund to the Complainant.

MFSD will not start procedures before the complainant has fully paid fees and out-of-pocket expences.

​

If MFSD, despite the reminder, does not receive payment within 6 (six) days of receiving the complaint, the latter will be considered abandoned and the procedure archived, without prejudice to the right of the Complainant to re-fill it.

The Complainant can request the appointment of three-member Panel, who will have the task of deciding the dispute.

​​

If there is no express request for the appointment of a three-member Panel, the procedure will be entrusted by MFSD to a one single Panelist.

​​

The fees of MFSD procedures varies depending on the legal nature of the Complainant, the number of Panelist whose appointment has been requested and the number of domain names covered by the procedure.

The Panelist may decide, upon the request of a party, at his/her own discretion and in exceptional cases, to question the parties personally or take witness evidence, determining the additional costs to be borne by the requesting party which must be paid before the meeting, even remotely, under penalty of forfeiture of the request.

The Panelist does not decide on the expenses, including legal or technical ones, incurred by the Complainant or Respondent for the (optional) assistance of a professional in the procedure, which is recommended but not mandatory.

The Complainant or the Respondent will be able to take action to collect the expenses before the Judge, given the unjustified disbursement and the existence of documents (the Panelist's decision and the MFSD invoice) proving the expense.

The fees of procedures involving two or more domains owned by the same registrant are calculated by adding to the amount of the procedure per n° 1 domain the additional one indicated below. For example, a multiple procedure filed by a natural person for transfer n° 5 domains decided by n° 1 Panelist will cost a total of € 2000: (900 per 1 domain + 600 per the second additional domain + 200 per the 3rd additional domain + 300 (150 x 2) per the 4th and 5th additional domains)
