2025 URS Reform in Focus: What Trademark Holders and Registrants Need to Know

As domain name disputes become more frequent in an increasingly digital world, trademark enforcement mechanisms must evolve in parallel. The recent reform of the Uniform Rapid Suspension (URS) system — initially introduced by ICANN in 2013 — has strengthened the efficiency and clarity of this critical rights protection mechanism. Below is a comprehensive overview of the revised URS framework for both complainants and respondents navigating domain-related trademark conflicts.



A Swift Remedy for Clear-Cut Infringement



The URS system is a streamlined and cost-effective administrative procedure designed for cases of blatant trademark abuse, specifically targeting cybersquatting under ICANN’s generic top-level domains (gTLDs). Unlike the UDRP, the URS does not transfer domain ownership but instead offers a single remedy: suspension of the disputed domain for the remainder of the registration period. Prevailing complainants may optionally extend the suspension by one additional year at standard commercial rates.



Filing a URS Complaint: Prerequisites and Procedure



Trademark owners seeking to initiate URS proceedings must first ensure their eligibility and gather sufficient evidence, including proof of rights and documentation demonstrating clear infringement. After selecting an ICANN-accredited URS provider — such as MFSD — the complainant must adhere to the URS Rules, the Procedure, and any supplemental rules of the chosen provider.



Key procedural steps include:


• Drafting a concise, well-supported complaint


• Submitting the complaint via the provider’s platform


• Paying the applicable filing fees (550 €)


• Cooperating with provider inquiries until a final determination is issued



If successful, the complainant’s remedy is limited to suspension of the domain, without transfer of ownership. Once the suspension expires, the domain is released and becomes available for new registration.



Responding to a URS Complaint: Registrant Rights and Timelines



Registrants receive a Notice of Complaint and have 14 calendar days to submit a response. The URS allows self-representation, but respondents may engage legal counsel due to the often complex legal and technical issues involved. A response must directly address each allegation, include supporting documentation, and comply with the 2,500-word limit (excluding appendices).



For complaints involving fewer than 15 domain names, filing a response is generally free of charge. However, if 15 or more domains are challenged, a response fee may apply, refundable if the registrant prevails.



Failure to respond within the 14-day window results in a default determination—but this is not an automatic loss. The URS allows defaulting respondents to seek a post-suspension review within six months, with a possible six-month extension.



Appeals and Abuse Prevention



Both parties may request a de novo appeal within 14 days of a decision. However, respondents in default have a separate, extended timeline for seeking review under URS Procedure Sections 6.4 and 6.5. Notably, the URS system now includes enhanced safeguards against abusive complaints. Examiners may, on their own initiative or at the respondent’s request, identify filings made for improper purposes, including harassment or deliberate falsehoods.



Streamlined Timelines and Cost Efficiency



One of the key strengths of the URS remains its speed: decisions are typically issued within three weeks of filing. The affordability and predictability of the process make it particularly attractive for enforcing trademark rights against egregious and straightforward cases of cybersquatting.
