🌐 From URS to Arbitration: MFSD’s Proposals for the Next Generation of ICANN Rights Protection Mechanisms

MFSD has submitted its Public Comment on ICANN’s proposed implementation of the IGO/INGO Curative Rights Policy Recommendations, approaching the consultation from the operational perspective of an ICANN-approved URS Provider.

The submission focuses on five priorities:

1. preserving the speed and simplicity of the URS,

2. promoting consistent implementation across Providers,

3. creating an effective operational interface between URS proceedings and arbitration,

4. establishing transparent standards for ICANN-designated arbitral institutions, and

5. developing ongoing coordination among ICANN org, Providers, arbitral institutions, Registrars, and Registry Operators.

MFSD also proposes a Provider–Arbitral Institution Operational Protocol (PAIOP) and invites ICANN to clarify whether an existing URS Provider could qualify as an arbitral institution, subject to appropriate functional separation and conflict-of-interest safeguards.

The broader objective is a more integrated, interoperable, and resilient dispute resolution architecture within ICANN’s Rights Protection Mechanisms.
